dc.description.abstract대부분의 아프리카 국가들은 1960년대에 식민지 국가를 벗어나 독립을 하였다. 이후 최근까지 아프리카의 주요 산유국들은 자원수출을 바탕으로 높은 경제성장률을 보여 왔고, 1990년 이후 국가 간 분쟁과 내전이 종식되면서 정치적으로 안정을 찾아가고 있다. 즉 아프리카의 많은 국가들은 정치적 안정과 석유, 천연가스 등 풍부한 자원, 그리고 높은 인구 증가를 통해 정치적, 경제적으로 발전하고 있으며, 세계적으로 관심이 없던 지역에서 투자 관심국으로 변화하고 있다. 이에 따라 많은 국가들이 다양한 방식을 통해 아프리카에 진출하고 있는데, 서구 열강뿐만 아니라 아시아 지역에서는 한국, 중국, 일본 등도 정부차원, 민간차원에서 아프리카에 대한 진출을 꾸준히 확대하고 있다. 아프리카에 대한 투자와 관련해서는 투자건수, 투자규모의 증가와 더불어 그 분쟁도 꾸준히 늘어나고 있지만, 이러한 분쟁을 해결하기 위한 절차나 수단에 대한 연구는 아직 미미한 수준이다. 투자와 관련된 분쟁을 해결하기 위한 수단으로 사법절차나 중재절차가 있을 수 있는데, 본고에서는 아프리카 국가 중 가장 많은 인구를 가지고 있고, 최근 높은 경제성장을 보이고 있는 나이지리아의 사법제도와 중재제도에 대해 살펴봄으로써 부족하지만 분쟁해결 절차에 대한 이해를 돕고자 한다. For various political and economic reasons, Africa has become an important investment destination internationally. In the last 20 years, Africa has seen pronounced growth in foreign investment. Between 2002 and 2012, the acquisition of African assets by foreign investors totalled US$ 204bn in value, with the total number of deals almost doubling, from approximately 1,600 to just over 3,000. The question is how should disputes in relation to these investments be dealt with. There are two main types, arbitration and litigation in national court. Many of the parties investing in Africa are familiar with using arbitration in their contracts and will typically choose one of the recognised arbitration centers around the world(including Africa states) using the main institutional rules such as the ICC. The use of arbitration as a dispute resolution mechanism is quickly gaining ground in Nigeria. The rules mostly used are the Arbitration Rules contained in the Arbitration and Conciliation Act. Nigeria is a developing country and one of the state policies at the moment is to attract foreign investment to create growth and development of its economy. The need for investments makes it obligatory for Nigeria to comply with international expectations even in the field of dispute settlement. In this paper, legal system and arbitration system in Nigeria are examined.en_US
