민사소송 인지액에 관한 이론적 분석: 소가 부풀리기 유인을 중심으로

Abstract

본 논문은 민사소송비용 중 인지액에 관해 여러 측면에서 분석을 수행하고 정책적 함의를 제시하였다. 먼저 우리나라의 인지액 체계를 살펴보고 인지액 규모를 주요 해외국과 비교한 후, 이론 모형을 구성하여 인지액 체계가 의사결정에 미치는 영향을 소가 부풀리기유인을 중심으로 분석하였다. 이러한 현황 파악과 이론적 분석을 바탕으로 다음과 같은 정책적 함의를 도출하였다. 첫째, 인지액 체계의 단순화가 바람직한 것은 사실이나 단지 단순화를 위해 정액제적 요소를 도입하는 데에는 신중할 필요가 있다. 둘째, 역진적 인지액체계를 통해 소가 부풀리기를 막는 동시에 그 억제효과가 과도하지 않게 하려는 노력은 소기의 목적을 달성하기 어렵다. 셋째, 현행 인지액 수준의 적정 여부를 판단하고 조정하는작업은 쉽지 않으며, 그보다는 인지액의 성격을 분명히 하고 그에 따라 인지액 수준을 조정하는 방안이 더 합리적이다. This paper analyzes the court fee system for civil litigation in various aspects. We first survey the court fee system in Korea and compare it with those of other countries. A theoretical model is set up to analyze the effect of the fee system on people’s decision making, especially on the incentive to overreport the value of litigation. Based on the survey and theoretical analyses, we obtain the following policy implications: First, simplifying the fee system has its own virtue but it is not advisable to introduce flat-fee elements just for the sake of simplification. Second, it is not feasible to construct a regressive fee system that deters overreporting of the litigation value and at the same time makes the deterrence effect not too excessive. Third, it is very hard to judge whether the current fee level is optimal; a better approach would be to first determine the nature of the court fee and then revise the fee system accordingly.
