지방자치단체 인사청문회제도의 도입실태 분석

Abstract

본 연구는 지방자치단체에서 시행하고 있는 인사청문회 제도의 운영 실태를 분석하고, 그 문제점과 개선방안 및 정책적 시사점을 제시하는 데 있다. 현재 지방자치단체에서는 일부 고위직과 지방공기업 사장 등에 대한 인사검증을 다양한 형태로 운영해 오고 있다. 첫째, 법률·조례에 따른 사전검증, 둘째, 의회예규 또는 단체장과 의회간 협약을 통한 사전검증, 셋째, 조례를 근거로 한 사후검증 등으로 분류할 수 있다. 그러나 인사청문의 제도적 안정성과 지속성을 위해서는 관련 법률의 개정이 무엇보다 선행되어야 하고, 검증기준과 자료제출 명확화, 청문 결과의 구속력 부여, 검증시간 확대, 청문과정 공개, 피청문자의 능력과 자질향상 등의 제도 개선이 필요함을 확인하였다. 본 연구는 최근 지방에서 도입 운용되고 있는 인사청문회에 대한 기술적․탐색적 연구로서 아직까지 지방정부의 인사청문회 운영 실태에 대한 연구가 부족한 상황에서 인사청문회 제도를 유형별로 분류하고, 그 도입 실태를 비교 분석하여 향후 인사청문회 제도에 대한 시론적 연구로 나름대로 의미를 지닌다. This study aims to analyse actual operation condition of confirmation hearing system implemented in local autonomous governments, disclose its problems, and suggest desirable alternatives and its policy implications. Currently local governments operate personnel qualification for a few high ranking posts and presidents for local public corporations in various ways, such as advance verification system according to the corresponding law and regulation, advance verification prescribed in the local council regulation or by the agreement between the head of local government and the local council, and post verification based on the related ordinance. For securing stability and continuity of the personnel hearing system, most of all, the applicable law should be amended in advance. Next, institutional improvement plans, such as specification of verification criteria and submission of information, grant a binding force on hearing results, extending verification time, disclosing the hearing process, and improvement of ability and talent of the hearing party concerned, are implemented. This is a descriptive research for the confirmation hearing system of local autonomous governments, of which operation condition has not been studied sufficiently. The systems have been classified by their types, and the actual condition of implementing the system is compared and analysed in this study. This preliminary study has implication for the future confirmation hearing system of a local autonomous government.
