OTT 사업자와 신탁관리단체의 음악저작권 사용료 분쟁에 대한 연구

2020년 이후 코로나19에 따른 사회적 거리 두기 제도가 시행되면서 비대면 문화의 확산으로 일명 ‘집콕’, ‘방콕’이라는 개념의 탄생과 함께 OTT 서비스는 더욱 폭발적으로 성장하였다. OTT 서비스의 발전에 따라 최근 몇 년 사이에 콘텐츠 이용 방식의 큰 변화가 이루어졌고 언제 어디서나 내가 원하는 콘텐츠를 골라볼 수 있는 OTT 서비스는 디지털 유통의 중심에 서게 되었다. 그러나 OTT 서비스는 기존에 없던 새로운 분야이기 때문에 이를 보호하고 규제할 수 있는 제도나 정책이 미비한 수준이었다. 이에 OTT 서비스 플랫폼을 두고 각종 저작권 관련 갈등이 나타났다.

이에 본 연구에서는 OTT 플랫폼의 등장에 따른 저작권 관련 갈등의 대표적인 예로 2020년부터 현재까지 계속되고 있는 OTT 사업자와 신탁관리단체의 음악저작권료 분쟁에 대해 알아보았다. 문화체육관광부가 OTT 사업자와 신탁관리단체간의 갈등을 중재하기 위해 한국음악저작권협회의 음악저작물 사용료 징수규정을 수정 승인하였음에도 불구하고 갈등이 지속되는 원인과 음악저작권 권리자와 OTT 사업자 간의 분쟁을 해결할 수 있는 방안에 대해 검토해보았다.

검토 과정에서 OTT 사업자와 신탁관리단체간의 분쟁의 쟁점에는 OTT 사업자의 법적 지위의 불명확성, 저작권신탁관리단체의 독점적 지위 등에 대한 문제가 있음을 확인하였고 이에 따라 발생하는 OTT 사업자의 이중징수 문제 또한 해결이 필요함을 인지하였다. OTT 서비스는 기존에 존재하지 않던 신산업이므로 그 도입 과정에서 각종 분쟁이 발생할 수 있으나 OTT 서비스는 앞으로도 계속 발전할 서비스이므로 분쟁에 대한 빠른 해결이 필요한 시점이다. 이에 본 연구에서는 OTT 사업자와 신탁관리단체의 음악저작권 사용료 분쟁 해결을 위한 해결방안을 모색하고자 하였다.

A Study on the Music Copyright Royalty Dispute between OTT Business Operators and Collective Management Organizations - Focusing on the copyright law issues of OTT services -

Since the implementation of social distancing system due to COVID-19 after 2020, the proliferation of untact culture has led to an explosive growth of OTT services. With the advancement of OTT services, there has been a significant shift in content consumption habits, and OTT services, allowing users to choose their desired content anywhere whenever, have become the focal point of digital distribution. However, as OTT services constitute a burgeoning industry, the regulations and policies for their protection and control are at a relatively inadequate level. Consequently, various copyright-related disputes have emerged concerning OTT service platforms.

In this study, we examined a prominent example of copyright-related conflicts arising from the emergence of OTT platforms—the ongoing dispute over music royalties between OTT operators and collective management organizations, which has persisted from 2020 to the present. In an effort to mediate the conflict between OTT operators and collective management organizations, despite the approval of modifications to the regulations governing the collection of music royalties, I have investigated the reasons for the continued dispute. Additionally, the research considered possible solutions to resolve conflicts between collective management organizations and OTT operators.

During the review process, it was identified that the key points of contention in the dispute between OTT operators and collective management organizations include the ambiguity of the legal status of OTT operators and issues related to the monopolistic position of copyright collective management organizations. Consequently, the issue of double collection by OTT operators arises and requires resolution. As OTT services constitute a burgeoning industry, various disputes may arise; however, given that OTT services are poised for continuous development, it is crucial to expedite the resolution of disputes. In this context, our study aims to explore solutions for resolving the dispute over music royalties between OTT operators and collective management organizations.
