사법행정 전산화에 따른 법원 시설물 운영비용 저감에 관한 연구

Abstract

1895년 근대적인 법원으로 시작하면서 국민의 생명권과 재산권을 보호하기 위해 부단한 노력을 하여 왔다. 초기 보수적이고 경직된 분위기의 사법부에서 쉽게 접근하고 보다 빠른 서비스를 제공하고자 노력하여 왔다. 소송이 필요한 경우 관할 법원에 직접 방문하여 종이 소장을 제출하면 각 당사자에게 소장 송달과 재판 기일 등 종이와 우편에 의존하였으며 많은 종이문서가 생성되었으며 재판에 필요한 소요시간 또한 많이 걸리는 시기도 있었다. 1979년부터 사법업무 전산화 타당성 조사 후 판례 데이터베이스 구축을 계기로 시작하였으며 전자기기의 급속한 발전과 더불어 이를 법정(재판장)에 도입 활용하고자 기존 종이문서를 스캔 작업하여 실물 화상기 또는 빔 프로젝터 장비 등을 이용하여 스크린 및 대형 모니터에 표현하면서 원활한 재판과 당사자들 간의 이해도를 향상 시킬 수 있었다. 전자 파일화 된 기록 자료를 USB 등과 같은 저장매체를 이용 법정에 있는 노트북 또는 개인 노트북에 연결하여 재판을 진행할 수 있게 되었다. 법원의 전산화로 인한 국민에게 보다 신속하고 빠른 서비스를 가져왔으나 그 효과 분석에 대한 연구는 극히 미비한 실정이다. 본 연구에서는 종이 기록물 관리 운영비와 시설비 운영비 및 전산화에 따른 효과에 대해 연구하고자 한다. 전자 파일링을 통하여 재판이 보다 신속 정확한 재판 과정에서 발생하는 종이 기록물의 발생이 현저히 줄었으며 전자소송 도입에 따른 자동화로 업무처리 속도와 업무 능률도 좋아졌다. 그래서 종이 기록물량 감소에 따른 서고의 운영비, 폐기 비용 및 자동화로 인한 인건비 절감 효과를 연구하고자 한다.| In 1895, a modern court started and it has continuously tried to protect life and property rights of the people. During its early stages, the court had conservative and rigid atmosphere but it has made an effort to provide easier accessibility and faster services. In the past, if litigation was needed, people had to visit a competent court and provide paper documents to each official in charge in person, and then a lot of papers had been spent while the involved person would get paper documents of a summons with trial date and some letters. In addition, a lot of time was quite long. Since 1979, as database construction of judicial precedent started after investigating feasibility of computerization of judicial tasks, computerization has been established. Electronic devices have been developed rapidly, and they have been introduced and utilized in courtrooms. It is possible for trials to proceed smoothly and for involved parties to improve their understandings, by scanning their paper documents and presenting them on a big screen or a monitor using physical imaging devices or beam projectors. In terms of the digitization files of recording documents, trials proceed using them by using storage devices like USB drives through laptops which are in the courtroom or individual laptops. Due to the computerization of the judiciary, faster and efficient services are given to the citizens but there are few studies on the computerized court rooms and their effects. This study is to research operational costs of paper recording management and it is to examine effects of computerization including the cost of equipment and operating. The introduction of computerized electric files could reduce paper records significantly, which have been produced in trials that become faster and more precise trials. In addition, automation resulting from adopting electronic litigation could improve speed and efficiency of tasks in the court. Therefore, this study aims to identify operational costs of archives depending on paper records reduction, costs of paper record disposal, and cost saving effects of the automation on personnel expenses.
