한국형 자치경찰제도의 구성 및 운영방안에 관한 연구

Abstract

autonomous police activities are conducted at the level of the residents; it approaches the problem with an perspective of residents; and the autonomous police system is provided by securing free participation of residents according to the local situation, it would be expected that this system makes driving force to the dual model, which is not only for providing security services with distinctiveness and specificity that the autonomous police has but also for stabilizing the autonomous police system by securing reliability of residents, which is different with the past condition when only national police existed. ; 지난 2021년은 우리나라의 유구한 경찰 역사에 큰 획을 그은 한 해이다. 광복 후 자치경찰제 도입에 대한 찬성과 반대 등 많은 논의와 시도 속에 탄생한 현행 자치경찰제는 향후 우리나라의 경찰의 역할과 기능에도 큰변화를 가져올 것으로 기대한다. 이 연구의 목적은 현행 자치경찰제도가 본래의 기능과 역할을 하고 효율적이고 안정적인 정착을 위한 운영 방안을 제시하는데 있다. 이러한 연구의 목적 달성을 위해 제1장에서는 연구의 배경과 목적, 범위, 방법과 구성에 대해 기술하였고, 제2장에서는 자치경찰제의 이론적 배경을 통하여 자치경찰제의 본질을 파악하고자 하였다. 제3장에서는 한국형 자치경찰제도의 구성과 운영 현황에 대해 서울시자치경찰을 중심으로 조직 구조, 인사 제도, 사무 범위, 재정 운영 등을 살펴보았다. 제4장에서는 오랜 역사와 전통을 가진 외국의 자치경찰제도와 이원화 모형 도입을 위한 검증을 위해 현행 자치경찰제 전국 시행 이전의 제주특별자치도의 제주자치경찰을 분석하고, 현행 자치경찰제도의 발전을 위한 시사점을 도출하고자 하였다. 제5장에서는 현행 자치경찰제도의 운영 실태를 중심으로 분석한 문제점과 안정적 운영을 위한 발전방안을 제시하였다. 연구의 결과 첫째, 일원적 모형의 조직 구조는 자치경찰사무담당의 소속감 결여로 인한 사기저하와 치안서비스의 저하, 지구대ㆍ파출소에 대한 소속 변경으로 시ㆍ도 자치경찰위원회의 지휘ㆍ감독권과 감사권 행사의 어려움, 경찰청과와 자치경찰위원회의 권한 충돌에 대한 해결 법령 부재, 자치경찰 운영에 있어서 주민의 실질적 참여제도 부재 등이 문제로 제기된다. 현행 자치경찰제 운영 기간을 고려하여 제도권 범위 내에서 우선적으로 자치경찰에 대한 복지와 후생제도 확대, 주민이 자치경찰 운영에 실질적으로 참여 할 수 있는 제도 마련 등 현행 자치경찰제도의 안정적인 정착이 우선 되어야 하며, 장기적으로 국가경찰과 자치경찰의 이원적 모형으로의 점진적 변화가 필요하다고 할 수 있다. 둘째, 자치경찰에 대한 임용권과 관련하여 자치경찰위원회 파견 경찰공무원의 필요정원, 자치경찰의 사기향상을 위한 인사 인센티브 제공 등 관련 법령의 개정과 별도의 자치경찰에 대한 특별승진제도 운영, 시ㆍ도 지사의 승진 추천권, 근무평정권, 성과평가권 등을 부여하여 현행 자치경찰제도의 임용권 규정을 실질적으로 보장할 필요가 있다. 셋째, 자치경찰사무 법령의 획일성과 제한성은 지역의 창의성과 다양성을 제한하고, 사무 범위와 집행방법의 경직성은 지역 내 치안수요의 불확실과 치안서비스 제공의 효율성을 저하시킬 우려가 있다. 이에 지방행정 사무와 자치경찰 사무를 효율적으로 연계하여 시너지 효과를 낸다면 진정한 자치경찰제 시행의 의미가 있는 치안정책이 시행될 것이다. 넷째, 자치경찰의 재정확보와 예산편성 등에 관한 구체적인 방법에 대한 법령 등 규정이 없어 자치경찰의 재정 운영은 매우 불안하다고 할 수 있다 또한 예산편성에 대한 경찰청장의 사전 의견청취는 재정운영의 자율성을 침해할 우려가 크다. 따라서 자치경찰의 안정적 재정 운영을 위해서는 자치경찰교부세 도입 등 신설 재원 확보 방안이 필요하다. 무엇보다 우리나라의 자치경찰제도의 안정적 정착을 위해서는 자치경찰제도 시행에 있어 현대 복지국가의 봉사기능을 강조한 경찰의 기능적 역할과 치안수요의 주체인 주민이 실질적으로 자치경찰제 시행을 체감하는 것이 가장 우선되어야 한다. 즉 자치경찰에 대한 주민들의 인식 향상과 자치경찰 활동이 주민의 눈높이에서 이루어지며, 주민의 관점에서 문제에 접근하고, 주민의 자유로운 참여의 보장을 통해 지역실정에 맞는 자치경찰의 치안서비스가 제공 된다면, 국가경찰만 존재하던 과거와는 달리 자치경찰만의 차별성과 특수성을 갖는 치안서비스의 제공과, 주민들의 신뢰성 확보를 통해 현행 자치경찰제도의 안정적 정착과 나아가 이원형 모델로의 추진의 원동력이 될 것이라고 생각한다.

| The purpose of this study is to suggest an operational plan for the efficient and stable settlement of the current autonomous police system in its original function and role. To achieve the purpose of this study, in Chapter 1 this study described the background, purpose, scope, method and composition of the study, and in Chapter 2 it tried to understand the essence of the autonomous police system through the theoretical background of the autonomous police system. In chapter 3, regarding the composition and operation of the Korean-style autonomous police system, this study reviewed the organizational structure, personnel system, scope of work, and financial operation by focusing on the Seoul Metropolitan Police. In Chapter 4, in order to verify the introduction of a dual model and foreign autonomous police system that has a long history and tradition, this study analyzed the Jeju Autonomous Police of Jeju Special Self-Governing Province, which existed before the nationwide implementation of the current autonomous police system and it is to draw implications of the system. In chapter 5, this study presented problems and development plans for stable operation, focusing on the current operating conditions of the autonomous police system. As a result of the study, first, this study raised some problems. The organizational structure of the uni-dimensional model was related to difficulties such as decrease in morale and in security service due to a lack of a sense of belonging of the self-governing police officer. There are difficulties with the exercise of command, supervision, and audit rights in the city autonomous police committee due to the change of affiliation to the district corps and police box. There is a difficulty in the absence of laws to resolve authoritative conflicts between the National Police Agency and the autonomous police committee. There is a difficulty in the absence of a system for resident’s actual participation in the operation of the autonomous police. Considering the period of operation of the current autonomous police system, the priority should be given to the stable establishment of the current autonomous police system within the scope of the system, including expanding welfare and welfare systems for autonomous police and another system that allows residents to participate in the operation of the autonomous police. In the long-term perspective, it can be said that it is necessary to have a gradual change to the dual model including both the national police and the autonomous police. Second, it is necessary to secure the appointment right for autonomous police by revising related laws including dispatch of the autonomous police committee, the required number of people, and provision of personnel incentive to improve morale and by granting operation of an exceptional special promotion system, recommendation for promotion by city and provincial governors, efficiency rating right, and performance evaluation right, so that regulations of appointment rights in the current autonomous police system should be practically secured. Third, the uniformity and limitation of local police affairs laws restrain creativity and diversity in a region, and the rigidity of the scope and execution method of the local police force may reduce the uncertainty of the local security demand and the efficiency of security service provision. Therefore, if the synergy effect is created by efficiently linking local administrative affairs and autonomous police affairs, a significant security policy of a true autonomous police system will be implemented. Fourth, it can be said that the financial operation of the autonomous police is very unstable because there are no laws and regulations on specific methods for securing finances and budgeting for the autonomous police. Also, hearing the opinions of the Commissioner General of the National Police Agency in advance on the budget formation is likely to infringe on the autonomy of financial management. Therefore, for the stable financial operation of self-governing police, it is necessary to secure new financial resources such as the introduction of the autonomous police grant tax. Above all, in order to make stable the establishment of the autonomous police system in Korea, it is the first priority to realize the functional role of the police, which emphasizes the service function of the modern welfare nation when it comes to operating the autonomous police system, and also it is the first priority for the residents, who are the main agents of the demand for security, to practically recognize the implementation of the autonomous police system.
