해외공사 프로젝트에서 발생하는 클레임 요인 분석 및 개선방안

Abstract

산업혁명 이후 국지적인 전염병(메르스, 사스 등)이 있었으나 이번 COVID-19와 같은 전 세계적인 전염병 유행은 없었다. 전례가 없는 전염병 대유행으로 세계 각국에서는 여러 가지 예방조치 등을 선제적으로 시행하였고, 그 결과 산업 전반에 많은 영향을 미쳤습니다. 건설 현장에서는 첫 번째로 경제 위축 및 저성장을 고려하여 발주 중인 물량을 축소하거나 미루는 일이 발생하였습니다. 대형프로젝트의 경우 길게는 10년 후의 경제 상황을 예측하여 투자하는 사업인데 COVID-19로 인해 불확실성이 커져 사업을 축소하는 발주처가 많아진 것입니다. 두 번째로는 COVID-19로 인한 언택트(Untact) 산업의 활성화가 되었습니다. 콘택트(Contact)에서 부정의 의미인 언(Un)을 합성한 말로 기술을 통해 사람과의 접촉 없이 생활한다는 것입니다. 건설산업은 대표적인 노동집약적인 산업인데 COVID-19로 인한 언택트 산업의 활성화로 건설산업은 가장 큰 타격을 받을 것으로 보입니다. 세 번째로는 국가별로 COVID-19에 대응하는 방법이 다르게 나타나고 있습니다. 대표적으로 스웨덴의 경우에는 COVID-19로 인한 이동 제한을 아예 하지 않는 경우도 있고, 싱가폴과 같이 국가적으로 이동 제한을 강력하게 취하는 국가도 있었습니다. 그 결과 건설 현장에 미치는 영향도 다르게 나타나고 있습니다. 이러한 COVID-19로 인한 명백한 지연 상황이 발생하였음에도 불구하고 발주처와의 계약관계에 따라 보상이 가능한 부분이 있고 보상을 받지 못하는 부분이 있다. 이에 국가별 대응 사례를 통해 시공자 측면에서 합리적인 대응 방안을 제시하고자 한다.; Since the Industrial Revolution, there have been local epidemics (MERS, SARS, etc.), but there has been no global epidemic epidemic like this COVID-19. However, uncertainty has increased due to COVID-19, which means that there are more clients that are reducing the business. Secondly, the untact industry was activated by COVID-19. It is a word that synthesizes Un, the meaning of negativity from Contact, and means living without contact with people through technology. The construction industry is a representative labor-intensive industry, and the construction industry is expected to be hit hardest by the activation of the untact industry due to COVID-19. Third, different countries have different ways to respond to COVID-19. Representatively, in Sweden, there are cases where movement restrictions due to COVID-19 are not at all applied, and there are countries such as Singapore that strongly enforce movement restrictions. As a result, the impact on the construction site is also showing differently. Despite the apparent delay caused by COVID-19, there are areas that can be compensated and some are not compensated depending on the contractual relationship with the client. Therefore, we intend to present reasonable countermeasures from the perspective of builders through countermeasures by country.
