유행성 전염병 사태에 대한 해외건설 계약 대응방안 연구

코로나 19의 대유행으로 역사상 유례없는 전 산업계의 위축이 동시에 발생하면서 이전에 발생했던 전염병을 포함한 자연재해 등의 위기보다 세계 경제의 침체가 장기화될 가능성이 커지고 있다. 또한, 이전의 위기들이 국지적이었고 일부 국가에 한정된 영향을 끼쳤던 반면 이번 위기는 사태 진정을 위한 전 세계적인 인원 및 물류를 포함한 입국 제한 및 이동 금지 등의 조치로 글로벌 가치 사슬의 규모를 축소시켜 건설을 포함한 대부분 산업이 영향을 받고 있다. 해외 건설 시장도 이러한 영향을 직접적으로 받고 있고, 세계 각지에서 건설 사업을 수행 중인 다수의 국내 건설 기업들은 입국 제한, 이동 중지, 작업 중지 혹은 축소 등의 조치로 정상적인 현장 운영이 어려운 실정이다. 하지만 발주처와의 계약관계에 따라 이러한 위기상황으로 발생하는 공기 지연이나 추가 비용 발생에 대해 계약적으로 보상이 가능할 것으로 건설사에서는 예상하지만 현장이 위치한 국가 및 발주처의 계약 조건에 따라 이러한 보상이 가능한지 확인하고 발주자의 해석이 다를 수 있으므로 금번 전염병 대유행에 대한 계약 대응방안에 대한 조사 및 분석을 종합해 해외에 진출해 있는 건설기업들의 코로나 사태와 같은 불가항력 사태와 같은 상황에서 피해를 최소화하기 위한 발주처와 계약적 대응 방안을 제시하고자 하였다.; As the corona 19 pandemic caused an unprecedented contraction of all industries in history, the possibility of a prolonged global economic recession is increasing rather than the crisis of natural disasters, including the previous epidemic.
