재건축 초과이익 환수제도의 개선을 위한 법정책적 연구

Abstract

본 연구는 재건축사업에서 발생하는 이익을 환수하여 사회적 형평에 기여해야 한다는 공익 추구정책과 토지의 사유재산권이 충돌하는 갈등을 합리적으로 개선하는 방안을 제시하는 것이다. 2019년 12월 27일 헌법재판소는 2014년 서울 용산구 소재 한남연립 재건축조합이 재건축부담금의 부과는 사유재산권 침해라며 청구한 헌법소원에 대하여 재판관 6:2 의견으로 합헌결정하였다. 재건축 초과이익 환수제도는 토지공개념 3법 중 개발이익환수에 관한 법률에 근거하고, 그 환수 이론의 뿌리를 A. Smith의 노동가치설과 지대이론 D. Ricardo의 차액지대설과 불로소득 이론, K. Marx의 절대지대설, H. George의 지공주의와 토지가치세설에 뿌리두고 있음을 연계하여 논하였다. 그리고 재건축부담금이 조세인지 부담금인지의 논란에 대하여 연구한바, 헌법재판관의 다수 의견은 조세로 보았고, 소수 의견은 부담금으로 보았으며, 학계의 다수설은 조세로 보는 것이 타당하다고 한다. 재건축부담금을 부담금으로 본다면 집단적 동질성의 문제, 미실현이익과세, 이중과세, 투기 목적이 아닌 실거주 목적의 1세대1주택의 담세력 등이 여러 가지 문제에 봉착하는 반면 이를 조세로 본다면 복잡한 논란과 공익과 사익간의 갈등이 해결될 것으로 보인다.; The purpose of this research is to propose a reasonable solution for the conflict between ‘private property rights to land’ and the ‘public good pursuing policy’ of the government which regards the gains created by housing reconstruction projects, demolishing old apartments (multi-unit dwellings) and constructing new apartments on the land, as unearned income of speculators and tries to restitute the gains and use them for social equity. On December 27, 2019, the Constitutional Court ruled by 6:2 of the judges Article 3, etc. of ‘Restitution of Excess Rebuilding Gains Act’ to be constitutional and not violating the Constitution in relation to the constitutional appeal filed 5 years and 3 months ago in 2014 by the Housing Reconstruction Association of Hannam Row House located in Yongsan-gu, Seoul on the grounds that the imposition of allotment to the reconstruction project infringed on private property rights.
