온라인게임 공간의 혐오표현 규제 가능성 — 시론적 연구 —

Abstract

온라인에서 발생하는 차별적이고 증오적인 성격의 혐오표현들에 대한 인식이 높아지고 전 세계가 이를 공유하며 대처하고자 하는 움직임을 보이는 데 비해, 같은 온라인공간을 기반으로 하는 온라인게임 공간의 혐오표현에 대한 논의는 여전히 미흡하다. 본 연구에서는 온라인게임이라는 공간의 특수성을 중심으로 하여 현재 온라인게임에서 가능한 강제적･자율적 규제를 비교함으로써 실효성 있는 방안을 탐색하고자 하였다. 그리고 이러한 목적을 위하여 먼저 온라인에서 발생하는 혐오표현의 매체중심적 규제 필요성 등 실제의 규제 현황을 살펴보았다. 결과적으로는 온라인게임의 혐오표현을 규제하기 위하여 강제적, 자율적, 형성적 방안이 중층적으로 시행되어야 할 것으로 나타났다. 또한, 법과 사회규범, 기술의 세 가지 규제가 골고루 동원되어야 하며, 모든 주체가 각 영역에서 맡아야 하는 역할이 있다는 점도 드러났다. 특히 이 중에서도 온라인게임이 가진 공간의 특징을 고려하여, 기업을 중심으로 한 약관과 기술적 규제를 바탕으로 국가 주도의 강제적 규제 범위를 줄여나가는 방향으로 진행되는 것이 바람직할 것으로 보인다. There is a movement to share and deal with the severity of online hatred expressions worldwide. Contrariwise, It is still not enough to cope with the hate speech in the online game space based on the same online space. We suggest appropriate regulatory measures by considering the specificity of the online game space and comparing the compulsory and self-regulations currently online, before identifying and classifying the hatred expressions in online games. To the study, we looked at the hate speech and the necessity of media-centered regulation. As a result, the hate speech in online games need to be enforced more than the compulsory, autonomous, and formative measures separately. Also, laws, social norms and technologies should be mobilized evenly, and all the actors have a role to play in each area of regulation. In particular, considering the efficiency and effectiveness of regulation, it should be pursued in the direction of decreasing the mandatory regulation of the nation, based on the company-centered terms and technical regulations.
