서울특별시 주택재개발정비사업의 문제점과 개선에 관한 연구

Abstract

주택재개발과 주택재건축은 실제에 있어 거의 동일한 기능을 수행하여 왔으나 주택재개발은 주로 공법의 영역에서 그리고 주택재건축은 주로 사법의 영역에서 다루어져 왔던 것은 도시 및 주거환경정비법이 시행되기 이전이다. 그러나 도시 및 주거환경정비법이라는 동일한 법률 아래에서 이제는 주택재개발과 재건축 모두 규율되게 되었으며, 도시 및 주거환경정비법에 의해 공공성이 특히 강화되었으므로 양자를 모두 공법의 영역에서 다루는데 있어 방해가 되지 않는다. 그리고 주택재개발·재건축과 관련하여 과거부터 지금까지 많은 문제들이 끊이지 않고 있는데, 이러한 문제들을 어떠한 법률규정과 법리에 의해 풀 수 있는가 하는 점이 중요한 관심거리로 떠오르고 있다. 이에 이 연구에서는 주택재개발과 관련되어 발생하는 문제가 어떠한 법적 문제들이 있고, 이들 문제들은 어떤 법 규정과 어떤 방법에 의해 해결되어야 하는지에 관하여 폭넓게 고찰을 하려고 한다. 한편, 주택재개발은 기반시설을 확충하고, 자신의 주거가 노후ㆍ불량화 되었을 경우 이를 효율적으로 개량하여 자신의 주거생활의 질을 높이는데 이바지 하는 제도로, 주택재개발에 대한 규제를 완화시켜 이들 공익과 사익을 충족시켜줄 필요가 있다. 그러나 다른 한편으로 주택재개발은 개발이익을 취득하려는 실제상의 목적에서 시행되어 투기를 조장하고 상대적 박탈감 등 심각한 사회적 문제를 야기하고 있으므로, 그에 대해 엄격한 공법적 규제를 할 필요가 있다. 이는 상이한 헌법적 가치가 서로 충돌하는 헌법적 문제임과 동시에, 실정법 규정을 해석하고 적용함에 있어 행정법의 문제이며, 경우에 따라서는 여러 가지 민사 법률관계를 발생시키는 민사 문제이기도 하다. 나아가 이는 현행법의 틀로서는 극복할 수 없기 때문에 입법론상의 문제를 초래하기도 한다. 따라서 이 연구에서는, 재도개선을 해야 될 부분과 그 개선안에 대하여 검토하여 공익과 사익의 조화에 출발점이 되고자 하였다.; Prior to the enforcement of the「urban and residing environment improvement law」, although housing Redevelopment and housing Reconstruction have performed almost the same functions in reality, the housing Redevelopment has been mainly dealt with in the area of public law and generally the housing Reconstruction in the area of private law. Therefore, although they conducted similar functions, it was undesirable to see both as the subject of the study. Yet, both the housing Redevelopment and the housing Reconstruction are subject to regulations by the same「urban and residing environment improvement law」,and the public interest was reinforced by the「urban and residing environment improvement law」. And there have been many disputes or conflicts in the past or even the present time concerning the housing Redevelopment. What type of legal regulations or legal principles can solve those disputes or conflicts has growing a significant target of public good and private interests. In consequence, this study reviews comprehensively what kinds of legal issues are waited on by the disputes or conflicts in relation to housing Redevelopment, how such legal issues should be worried out by what sort of legal regulations and legal methods. In addition to, housing Redevelopment is a system made to expand our infrastructure and to raise housing life quality with effect by improving aging and deteriorated houses. Therefore, it needs to expand our infrastructure and to satisfy those public good and private interests by mitigating regulations on the housing Redevelopment. On the other hand, housing Redevelopment is operated for the practical purpose of generating profits from development. So, it brings about speculations and causes serious social problems such as sense of comparative resentments and deprivations. It is also necessary to impose strict regulations on the housing Redevelopment from the public law perspective. It is a constitutional issue that different constitutional values mutually conflict with, and, at once, it is a matter of administrative law when it comes to interpreting and applying detailed rules and regulations. And, in some cases, this is a matter of private law problems which cause diverse relations of civil laws. Further, it can cause legislative problems which cannot be overcome by the framework of current law. Therefore in this study, there were some reviews on the harmonization between the public good and the private interests through the system reformation in the housing redevelopment in Seoul
