사회복지시설 민간위탁운영실태의 개선방안 연구

Abstract

1980년대 이후 OECD 국가들이 사회, 경제적인 변화를 겪으면서 새로운 공공관리체제의 구축을 위해 행정은 새로운 방안을 모색하여야만 했다. 더욱이 경기침체로 정부의 재정적자와 독점적으로 운영한 정부의 비효율적인 사회복지시설의 운영은 오늘날 IT기술의 급속한 발전으로 우리나라는 세계화, 지방화로 대변하는 새로운 변화의 시대를 맞이하여 사회복지서비스 민간부문의 역량과 활력을 이용한 효율적 운영이 요구되고 있다. 사회복지 분야에 있어서 민간위탁의 발전적 모습은 주민의 판단에 의한 서비스 질의 향상과 서비스에 대한 주민의 참여 속에 이루어지기도 한다. 특히 민간위탁의 추진은 1998년 ‘국민의 정부’ 출범 후 작은정부를 지향하는 행정조직관리에 있어서 매우 중요한 과제로 행정의 고비용·저효율 시스템을 개선하기 위해 적극적으로 추진하고 있다. 한국의 사회복지서비스가 민간부문의 역량과 활력을 이용한 효율적 운영을 요구하고 있는 시점에 사회복지시설 위탁에 관한 법제도가 미흡하고 민간위탁과정 선정기준의 미흡, 선정위원회 구성의 비전문성 등 문제가 나타나고 있다. 본 연구의 목적은 민간위탁 운영의 개선방안을 제시하고 서비스의 질 개선 등 민간위탁 장점의 극대화에 기여하고자 하는데 있다. 서울시 사회복지시설 운영형태는 1987년 27개소에서 2006년 말 394개소로 폭발적으로 증가하는 모습을 볼 수 있는데 이렇게 증가한 시설이 대부분 위탁형태로 운영되는 것을 볼 수 있다. 전국 사회복지관 운영주체현황과 서울특별시 복지서비스 민간위탁의 현황 등을 자료를 통해 우리나라의 복지서비스의 민간위탁은 미비한 실정이나 서비스 분야에서 활발히 이루어지고 있는 것을 볼 수 있다. 복지시설을 운영 하는데 있어서 문제점은 감독과 회계감사 중심의 형식적이며 잦은 지도·감독으로 인한 업무의 비효율성 초래 등 이다. 사회복지서비스는 무형의 서비스이므로 측정의 어려움, 서비스나 성과를 측정하고자 해도 전문적인 영역에 대하여 감독할 수가 없다는 점이다. 이러한 요인이 상호 작용하여 서비스 전달과정에 대한 행정적인 통제위주의 지도·감독이 이루어지고 있다. 그래서 실질적으로 의존하는 수단은 회계감사와 분기별 보고서이며 특히 회계감사는 가장 중요한 수단으로 인식하고 있다. 강남구의 민간위탁의 목적은 주민들의 다양한 서비스욕구에 부응하기 위해 민간위탁 경영방식을 도입하여 활성화하고 기업전략의 큰 틀로서 활용되고 있는 가운데 25개 부서 89개 업무에 대하여 추진하고 있으며 큰 성과를 거두고 있다. 강남구 사회복지시설 중 종합사회복지관 운영실태 및 현황과 청소년 대상 시설의 운영실적, 운영계획, 재정능력 등이 합리적이고 객관적으로 운영하고 있는지 분석하였다. 사회복지시설의 민간위탁은 서비스의 질 개선을 목적으로 위탁자 결정이 되어야 할 것이며 사회복지가 소비적일 수 밖에 없는 특수성을 감안하여 비용 절감만을 목적으로 하는 위탁은 배제 되어야 한다. 또한 공무원의 전문성 제고와 적절한 관리·감독체계의 구축이 필요한 것으로 사료된다. 현재 위탁업체 선정과 관련하여서는 사회복지사업법 및 동법 시행규칙 제23조에는 위탁의 계약체결에 관한 규정과 계약기간에 관한 규정 등이 있으나 수탁기관의 모집, 선정과정, 지도감독 등에 관한 규정이 없고 위탁계약 기간 만료 후 재위탁에 관한 규정도 없다. 또한 사회복지시설 위탁주체인 대부분의 자치구에서 사회복지시설 민간위탁에 관한 조례나 지침없이 시 지침을 준용하거나, 조례가 있는 경우도 선정 및 계약체결에 관한 구체적 규정이 미흡한 실정이다. 따라서 수탁기관의 선정에 있어서는 위탁업체 선정의 객관성, 공정성, 투명성을 확보하여 업무의 효율성을 도모하는데 중점을 두어야 한다. 또한 선정과정과 관련정보의 구체적 공개, 제한경쟁요소의 축소, 계약만료시 재위탁과정을 통한 경쟁성 확보, 지역내 특정업체에 의한 독점 방지, 공정한 심사위원회의 구성과 심의절차가 이루어지도록 해야 한다.; Since 1980s, O.E.C.D countries facing social and econonical chonges, should find newly proper way for eastablishing new public management systems. Nongoverment contracting out have been executed by administration systems intending Small Govermments since 1998(`Govermment of peoples started in 1998 ) and have been promoted in order to lessen heavy expenditure and low efficiency. Social welfare services by nongouvermental contracting out contribute to society. Great emphasis on efficiency may cause problems of large enterprises and of its private vwnership Therefore, it seems to be necessary for us to improve consciousness of corporate and proper management and control systems and to increase public service personnel specialty. and if public parties and private ones participated in same tender for management of social welfare facilities, we must choose proper porty only in considering their efficiency of services. and we must consider objectivity, fairness, clarity in case of selecting relevant party. in the beginning, we have to indicate dissatisfaction of concerned legistration and we make infabitants satisfied with proper choice of social welfare organization done by selection committee and finally we must meet their increasing demands for social welfare services. and I would like to study statistical data ftom seoul City and current status of social welfare facilities at GangNam-Gu in Seoul and submit various kinds of data which will be useful for finding the most ettective social welfare organization. partites and private ones par It is very important that operatons, sevices and functions of social ivelfare facilities depend on selecting efficient and competitive contracted party. The purpose of this study is to suggest better improvement plans for civil contractors by studying actual status of GangNam-Gu, Seoul after onalyzing problems of selecting contracted parties and of concerned legal regulations for civil carrying out of social welfare facilities. We must choose reliable parties for currying out social welfare specially by open tender(not by close tender) according to proper tender regulations which are approved by concerned parties including professors, professionals, residents & etc. Nawadays rapid development of information technology brings us new reforming times representing globalization and localization.
