방송통신 융합의 법제도적 방향성에 대한 연구

Abstract

최근 방송통신융합 현상에 따른 규제기구 통합관련 논의가 한참이다. 방송통신융합은 기술적으로 전송수단이 디지털화, 광대역화, 쌍방향화 하기 때문에 나타나는 산업경제적, 사회문화적 현상이다. 방송 및 통신망을 통해 개별적으로 운영되던 방송통신 영역이 상호 교류하거나 중복되면서, 산업경제적관점에서는 사업적 이윤 창출을 위한 가치 사슬 체제가 변하고 있고, 사회문화적으로는 그간 방송/통신 매체별로 사회가 지향하던 가치가 재구성되고 있는 것이다. 이처럼 방송통신 융합에 의해서 야기되는 산업경제적, 사회문화적 현상은 문화 산업 전체의 구조와 운영 전반에 대한 법적, 제도적 틀의 쇄신을 요구하고 있는 시점이다. 방송위원회 주도로 진행되는 현재의 방송통신 융합 단일기구 정립 움직임에 대해, 정보통신부가 규제기구 통합을 시기상조로 간주하며 '현 체제 유지'를 강변하는 것도 같은 맥락으로 해석할 수 있다. 시민 단체나 노조, 또는 노조 출신의 연구자들도 자신들의 정치적 이데올로기나 소속된 산업의 이해를 반영하기 위해 다양한 논리를 전개해 왔다. 현재는 국무조정실 산하 방송통신융합추진위원회에서 방송통신위원회설립및운영에관한법률(안)을 국회에 제출한 상황이다. 국회에서 올해 안에 통과될지 미지수이다. 이러한 상황에서 방송통신융합관련 법제도의 방향성을 연구하는 것은 시의성이 있다는 생각에서 진행하였다. 이런 맥락에서, 본 논문에서는 방송통신융합 정책 목표를 달성하기 위해, 정책 목표들을 세부적으로 어떻게 개념화할 것인지를 공익 관점에서 살펴보고, 정책 목표를 달성하기 위한 주도 정부기구로서 소위 (가칭)방송통신위원회의 법적구성을 해외사례를 통해 우리상황에 적합한 법적구성을 논의해 보았고 (가칭)방송통신위원회의 업무분장 ①국회와 (가칭)방송통신위원회 ②대통령과 (가칭)방송통신위원회 ③공정거래위원회와 (가칭)방송통신위원회 ④(가칭)방송통신위원회와 자율심의기구 ⑤(가칭)방송통신위원회와 업계 ⑥(가칭)방송통신위원회와 공적기금 등에 대해 논의한 후, 정책 목표들을 달성하기 위한 정책대안으로서 그간 제시된 다양한 정책안들의 타당성을 분석하려고 하였습니다.; Lately, debates have been hot about integration of regulatory bodies as broadcasting and communication are being fused. The fusion of broadcasting and communication may be an industrial and economic or a socio-cultural phenomenon as the transmission means are digitalized, broad-banded and two-way. Specifically, those broadcasting and communication services which had been separately operated have begun to exchange or fuse with each other and as a result, the value chain system for creation of business profits is changing from the industrial and economic perspective, while the values of society pursued by each broadcasting and communication media are being reorganized from the socio-cultural perspective. The industrial and economic or socio-cultural phenomenon resulting from fusion of broadcasting and communication requires innovation of the legal and institutional framework for the entire structure and operation of the cultural industry. In response to the movement initiated by Broadcasting Committee to establish a streamlined broadcasting and communication regulatory body, Ministry of Information and Communication argues that it would be too early to integrate the regulatory bodies and therefore, that the 'current systems should be maintained'. Such an argument may well be interpreted in the same context. NGOs, labor unions and researcher therefrom have unfolded diverse logics reflecting their political ideology or the interests of their industries. Recently, Broadcasting and Communication Fusion Committee under Government Affairs Coordination Office submitted to the National Assembly 'a Draft Law on Establishment and Operation of Broadcasting and Communication Committee'. It is not certain that the draft law would pass the National Assembly within this year. In such circumstances, it is deemed important to research into the directions for the legal systems for fusion of broadcasting and communication. In order to achieve the policy goals of fusing broadcasting and communication, this study reviewed how such policy goals should be conceptualized in details from a perspective of public interest and examined the foreign cases to discuss how the so-called Broadcasting and Communication Committee (hereunder referred to 'Committee') should be organized as a government authority to befit our conditions. Then, this study reviewed the ways for an ideal division of functions between (1) National Assembly and Committee, (2) President and Committee, (3) Fair Trade Commission and Committee, (4) autonomous deliberation Body and Committee, (5) businesses and Committee and (6) public funds and Committee. Based on the results of such reviews, the researcher analyzed diverse policy alternatives suggested so far to achieve the policy goals.
