경제범죄 현황과 대응방안에 관한 연구

Abstract

근래의 우리 사회는 경제규모가 급속하게 커졌다. 경제 규모가 커짐에 따라서 다양한 경제현상들이 발생되었다. 이에 반사회적 효과로서 경제관련 범죄가 급증하는 양상이 나타나고 있다. 경제범죄의 경우, 개인의 직접적인 피해는 물론, 기업에도 피해를 입힐 수 있으며 더 나아가 경제와 사회에도 미치는 영향이 상당할 수 있다. 본 연구에서는 경제범죄에 기초 작업으로 경제범죄의 개념정의를 시도하고 국가의 건전한 경제질서를 침해, 위협하거나 일반적 경제생활에 있어서 다수인에게 지대한 영향을 미치는 경제범죄의 유형을 분석한 다음 보다 효율적인 경제범죄에 대한 대책을 모색하려 한다. 경제범죄의 개념과 유형, 실태분석을 통한 구체적인 규제대책을 제시하여 보았다. 경제범죄 현황을 살펴본 결과 현대의 컴퓨터와 인터넷 사용의 증가로 인하여 사이버 범죄가 급속한 증가세를 나타냈으며, 유형뿐만 아니라 무형의 지적재산권 관련 범죄도 과거에 비하여 늘어나고 있는 추세가 급격함을 알 수 있었다. 경제범죄에 대한 대책은 다음과 같다. 우선, 형사사법적인 대책으로는 경제범죄 수사의 전문화 및 전담부서의 운용, 법인에 대한 형사법적 대책, 형벌제도의 개선, 돈세탁의 규제를 들 수 있고, 다음으로 형사정책적인 대책으로서는 형사사법제도의 전산 · 정보화, 경미범죄의 비범죄화, 기타 새로운 제재 방안을 들 수 있고, 마지막 입법적 대책으로는 규제의 국제화, 입법기술상의 형식을 들 수 있다. 과거에 비하여 현재 사회는 급격히 변화하여 가고 있는 실정이다. 이에 경제 환경도 빠르게 변화가 나타나고 있다. 후속 연구에서는 본 연구에서 다루지 못한 새로운 경제범죄에 대하여 조사하고 논의하기를 기대해 본다.; Recently, our society has been developed radically in terms of economic size. As the economic size of society has been enlarged, various economic phenomena followed. And as a kind of anti-social effect, economic crime is gaining momentum. As a case of economic crime, it can not only cause direct personal damage but also cause some damages to companies, influencing the economy and society significantly. In this study, we should like to try to determine the economic crime conceptually as a groundwork for economic crime, and to find more efficient solutions to economic crime after analyzing the type of economic crime which threatens and infringes upon the security of sound economic order or influences unspecified individuals vastly in general economic life. And here, we presented concrete solutions to it, analyzing concept, types, and present condition of economic crime. After analyzing the present condition, we have found that because of recent increase in the use of computer and internet, cyber crime is gaining momentum, with crime related not only to tangible materials but also to intangible intellectual property also being on the sharp rise, contrary to past. The solutions for economic crime are following : First, in judiciary terms, the specialization of investigation regarding economic crime, judiciary countermeasure for criminals, improvision of punitive system and regulation of money-laundering can be considered. And next, as a matter of policy, computerization and informationalization of judiciary system, excluding the minor offense from crime, and other measures can be said. Finally, in legislative terms, internationalization of regulation and improvement in legislative technic. This society changes in a radical way, compared to past. And the wind of change has hit economic environment also. We expect to study and discuss another new economic crime which we couldn't examine this time in following study.
