Abstract

출소자 재범률 감소를 위하여 법무부 서울지방교정청에서 추진하고 있는 '희망등대 프로젝트'를 소개하면서 이 프로젝트의 이론적 기초인 회복적 사법 이론, 출소자가 당면한 사회적 상황, 각 국에서 유사하게 추진된 프로젝트 등을 서술하고, 이프로젝트가 성공적으로 수행되기 위해서 해결해야 될 과제 및 그 대안을 연구함.; This study is the introduction on the original and innovative 'lighthouse project of hope' related to restorative justice, which has been planned and carried by the Seoul regional headquarters since the March in 2007. It is stipulated that the goal of our correctional law is inmates' rehabilitation. The first article of the correctional law says that through correction and rehabilitation by segregation, we let inmates learn the sound national thought and labor spirit. And we help inmates' rehabilitation through the skill education. The rehabilitation of inmates or re-socialization means that inmates become good common people after release without a second offence. But the atmosphere of our society towards released inmates is still cool and there are little support for them. It is not strange that the ratio of a second offence is much too high under these circumstances. This study gives a simple introduction on various treatment ideology and shows the basic plan, the success subject of this project, its' conformity of corrections goal and the concrete cases of some countries which apply the restorative administration of justice, the concept of the restorative administration of justice. The restorative administration of justice means that a victim, an assaulter and community, all of them voluntarily participate in case solution, loss compensation and seek reconciliation among them. The restorative administration of justice has been developed as various patterns through numerous scholars and men of affairs since R.E. Barnett. The restorative administration of justice has been discussed since 1980s through conflict settlement like a assault - victim reconciliation. The result of the study shows that every country such as England has applied diverse practical mode like adjustment and conversation, family unit conference, circle, compensational probation, which contributed to the decrease of a second offense ratio. The restorative administration of justice is applicable to the overall extent of criminal judiciary like an investigation, trial, sentence execution. But though it is widely used under the name of agreement, adjustment in an investigation and trial process in Korea, there is little case which applied it in the step of release or sentence execution. So, this 'lighthouse project of hope' of Seoul regional headquarters will be a big event and new turning point of Korean Corrections because of the contribution of inmates' rehabilitation, the prevention of a second offense, the raising of interest in the victim and the guarantee of the human rights of inmates. The principal orders of 'lighthouse project of hope' are the successful rehabilitation, the restorative realization of justice and the creation of self-support for the prevention of a second offense. The success of this project will be helpful to prevent inmates from committing a crime again, lessen the social expenses and help inmates live well inside prison. It is expected that it will contribute to the uprising of the trust of Corrections and the solidarity of Community. However, we have lots of tough tasks to succeed in this project. For example, how can we persuade the general public into understanding the real meaning of this project? How can we get fund for this? How can't we get antagonism of the general public including victims during this project? It is too difficult for the Corrections Authorities by itself to get over theses problems and achieve this project. It will be meaningful only after all of the various governments, civil groups, religious groups, academic participate in it together. Therefore, this 'lighthouse project of hope' of Seoul regional headquarters will be a good chance to change social atmosphere affirmatively and refresh the goal of Corrections. I am sure that the successful rehabilitation of released inmates and the decrease of a second offense ratio will contribute greatly to the construction of peaceful and safe society.
