自治行政서비스의 效率的 民間委託方案에 관한 硏究

Abstract

본 연구는 자치행정서비스의 민간위탁을 성공적으로 집행하는데 필요한 요건을 중심으로 집행모델을 구성하고 이를 바탕으로 우리나라 지방정부의 민간위탁 집행실태를 사례를 중심으로 파악하여 문제점을 도출 한 다음 이러한 문제점을 극복할 수 있는 대안을 모색하는 데 그 목적이 있다. 본 논문에서는 탐색적인 차원에서, 우리나라에서 민간위탁이 실시되고 있는 몇 가지 사례에 대하여 과정과 실태를 파악하고, 이를 통하여 문제점과 시사점을 발견하고자 한다. 지역적인 범위로는 다른 지역에 비해 민간위탁의 여건을 잘 갖추고 있다고 할 수 있는 서울특별시를 대상으로 하였다. 연구방법은 문헌조사와 사례 및 통계조사 및 위탁업무 담당자를 대상으로 한 인터뷰 방법을 주로 사용하였다. 정부기능의 민간위탁을 통해 효과성과 효율성이 증진되는등 위탁의 이점을 실현하기 위해서는 이를 추진하는 과정, 곧 민간위탁을 실현함에 있어 반영되고 충족되어야 할 몇가지 요건들을 상정할 수 있다. 이러한 요건들은 크게 다음과 같은 세가지 측면에서 규명될 수 있다. 첫째, 정부의 민간위탁운영측면, 둘째, 위탁대상기능의 선정과정에서 고려되어야 할 위탁대상기능과 관련된 성격측면, 끝으로 이들 전제요건들을 고려하고 반영할 수 있는 제도적인 측면이 그것이다. 민간위탁운영측면에서의 전제요건들은 구체적으로 정부가 특정기업을 선정하여 정부기능을 위탁하는 과정에서 준수해야 할 요건들로서 적절한 위탁대상기관은 어떻게 선정하고, 위탁 서비스를 둘러싼 위탁기관과 수탁기관과의 관계는 어떻게 설정하고 관리할 것인가 등이다. 위탁대상기능 선정측면에서의 요건들은 위탁과정에서의 요건들을 용이하게 충족시킬 수 있는 위탁대상 서비스는 어떤 것들이 있으며 이를 어떻게 선정할 것인가에 관한 것이다. 끝으로 제도적인 측면에서의 요건들은 위탁운영측면에서의 요건들을 충족시킬 수 있도록 행정제도가 뒷받침하고 갖추어야 할 내용들이다. 한편 민간위탁에 대한 접근방법으로서의 이들 세가지 측면과 전제요건들은 기존에 실시되고 있는 민간위탁의 적합성을 분석 및 평가하고, 위탁의 실익이 확보될 수 있는 보다 합리적인 민간위탁 실현방안을 강구하는데 있어 준거가 될 수 있다. 민간위탁의 성공적 집행을 위한 제도적 장치로는 ① 민간업체들간의 공정한 경쟁을 증가시킬 수 있도록 공개입찰, 홍보 및 공정한 선택기준 등이 마련되어 있어야 한다. ② 위탁업무 담당 민간업체들을 동기 부여할 수 있는 적절한 긍정적인 인센티브와 비리와 나태를 방지할 수 있는 부정적인 인센티브 시스템이 확립되어 있어야 한다. ③ 민간업체가 계약을 성실히 준수하고 있는가를 효과적으로 감독 및 평가 할 수 있는 평가기준과 방법이 수립되어 있어야 한다.; This study explores the local governmental contracting out management processes. The major objectives of this study is to provide a better understanding of the practices of the contracting out management processes in the local government. The methodology of this study includes case studies of social welfare facility in Seoul Metropolitan Government, and interview methods. This study has two major purposes. First, the research seeks to figure out the major deterrent factors in privatizing environmental facilities of the local governments. The second essential purpose is to throw light upon the policy suggestions for accelerating the process of privatization in the local public environmental services. Based upon these findings, the policy recommendations are suggested as follows. ① Local governments need to conduct the operating performance analysis over local environmental functions. ② A retraining program is established to educate staff members of related public institutes, thus to produce the smaller and qualified technician group. ③ The systemic registration criteria are required to develope to filter in/out the qualified private environmental companies. The central government is suggested to deliver financial support, technical reeducation as well as the long-term contract guarantee for the registered companies which have proved their qualification. It is suggested that contracting out for public service is one of the most efficient arrangement to promote the local government productivity. However, the lack of appropriate tools and mechanism of the contracting out make the local government's contracting out inefficient. Finally, this study suggest that local government should make effort to promote competitiveness in its contracting process. It should be open and fair in its solicitation and evaluation for contract applications. In addition, precise performance monitoring system must be established.
