북한 도시계획법에 대한 고찰: 국토의 계획 및 이용에 관한 법률과의 비교를 중심으로

Abstract

본 연구의 목적은 북한 「도시계획법」의 내용과 함의를 검토하는 것이다. 본 연구에서는 북한 도시계획법의 내용을 분석하기 위해 「국토의 계획 및 이용에 관한 법률(국토계획법)」을 비교 기준으로 삼았다. 도시계획법은 국토계획법과 마찬가지로 국가 전역을 포괄하는 공간계획법으로서의 특성을 가지고 있다. 그러나 대체로 구체적인 내용이 부족하며 규제와 관리에 초점이 맞추어진 국토계획법과 달리 건설관리법으로서의 성격을 일부 갖고 있다. 또한 도시계획법은 토지의 취득 및 예산 관련 세부 사항이 부족하다. 도시계획법의 이러한 특징들은 법적 권한을 넘어서 행정권을 남용하는 경찰국가로서의 북한의 특성을 반영한다. 이는 최근 북한 체제의 시장화 경향에도 불구하고 투자의 불확실성을 높인다고 볼 수 있다. The purpose of this study is to examine the contents and implications of ‘the Urban Planning Act (UPA)’ of North Korea. To analyze the contents, ‘National Land Planning and Utilization Act (NPUA) is used as a criterion of comparison. UPA has the characteristics as a spatial planning law encompassing the whole country as well as NPUA. However, it generally lacks concrete contents while it has some characteristics as construction management law unlike NPUA centering on regulation and management. UPA lacks the details of the land acquisition and securing the budget. Those features of UPA show the characteristics of North Korea as a police state which used to abuse administrative authority without legal basis. It might enhance the uncertainty in investment despite the recent marketization trend of North Korea.
