2017년 헌법개정과정에의 시민참여와 헌법교육의 모색 - 1987년 헌법개정과정의 경험을 바탕으로 -

Abstract

2016년 11월 시민들의 항쟁과 대통령에 대한 탄핵 선고 이후로 국가개혁의 일환으로 1987년 헌법에 대한 개헌론이 활발하게 논의되고 있다. 그동안 우리 정치의 실패와 대통령들의 실패가 1987년 헌법이 가진 한계에 기인하는 것이라는 분석이 많았고, 이러한 틀을 바꿔야 개혁이 완성된다는 것이다. 물론 단순히 헌법만의 문제로 원인을 단순화시킬 수만은 없지만, 1987년 헌법이 그 장점에도 불구하고 문제가 없지 않았던 것도 사실이다.따라서 본 논문에서는 1987년 헌법이 시민항쟁을 통해 성취된 헌법이고, 따라서 대통령 직선제와 단임제라는 중요한 성취를 이루어냈음에도 불구하고, 시민들의 참여가 극도로 제한되고 정치엘리트 간의 협약으로 이루어진 헌법이라는 한계가 있었다는 점에 주목하였다. 2017년 현재 헌법개정과정에서는 이러한 한계를 극복하고 시민참여의 방안을 모색함으로써 더 나은 헌법개정을 이뤄냄과 동시에 시민들이 헌법개정에 참여함으로써 헌법교육의 효과를 누릴 수 있어야 한다는 점을 강조하였다.Since the citizens' protests in November 2016 and the impeachment of the president in March 2017, There are many arguments the 1987 Constitution should be revised as part of the national reform. There have been many analyzes that the failure of our politics and presidents have been caused by the limitations of the 1987 Constitution. Although the cause of failure is not only due to the constitutional provisions, it is also true that the 1987 constitution had problems despite its merits.Therefore, in this paper, although the 1987 Constitution was achieved through the democratic uprising, and despite the important accomplishment of the presidential election system and the unilateral election system, the Constitution was limited to the participation of citizens in the process of amending the Constitution. In the process of revising the Constitution as of 2017, it emphasized that it should be able to overcome these limitations and seek the ways of citizen participation to achieve a better constitutional amendment and at the same time to enjoy the effect of constitutional education by citizens participating in amendment of the Constitution.
