일본인납치문제와 일본의 대북정책 - 평양선언과 스톡홀름 합의를 중심으로 -

Abstract

이 논문은 일본인 납치자 문제에 대한 평양선언과 스톡홀름 합의의 차이점 및 이행 중단 배경과 재개, 그리고 그 과정에서 일본 정부가 대북제재법을 어떻게 활용했는지를 고찰하였다. 북한의 계속된 핵실험과 미사일 발사로 일본이 더욱 강화된 독자제재를 취함으로써 두 합의는 제 기능을 하지 못했지만, 다음과 같은 점에서 의미가 있었다. 첫째, 평양선언에서 북한은 일본인 납치를 인정하였고 스톡홀름 합의에서는 이 문제가 아직도 미해결 상태임을 확인하였다. 둘째, 일본은 납치자 해결 노력 과정에서 외국환 및 외국무역법, 특정선박입항금지법, 북조선인권법의 개정 또는 제정을 통해 독자적 제재 및 완화 수단을 확보하였다. 셋째, 스톡홀름 합의는 평양선언과 달리 납치자 문제를 북한의 핵 및 미사일 문제와 분리하여 다루었다. 일본이 두 합의를 추진한 배경에는 일본 국민의 이 문제에 대한 지대한 관심뿐만 아니라 집권자들의 국내적 정치상황의 고려도 작용하였다.This paper depicts differences between the Pyongyang Declaration and the Stockholm Agreement and examines the background of the suspension of the implementation and resumption; also, it considers how Japanese government has made use of North Korea Sanction Acts in the process of the effort to resolve the problem of the abduction. While the two agreements could not work properly because Japanese government took strengthened measures against North Korea that continues both nuclear tests and missile launchings, they are significant on the following reasons: First, in the Pyongyang Declaration, North Korea formally recognized the abduction of Japanese citizens, and the Stockholm Agreement confirmed that this problem was still unsolved. Second, Japan secured its own means of sanctions and mitigation through the revision or the enactment of Foreign Exchange and Foreign Trade Act, Act on Special Measures concerning Prohibition of Entry Specified Ships into Port, Act on Handling of Abduction Issues and Other Human Right Issues Related to North Korean Authorities. Third, contrary to the Pyongyang Declaration, the Stockholm Agreement dissociated the problem of the abductions from both North Korea’s nuclear and the missile issue, so it dealt with only the former. Japanese government promoted both agreements in the consideration of domestic political situation as well as great attention of the people.
