국가인권위원회의 표현의 자유 보호 현황과 한계에 관한 연구 — 진정사례 분석을 중심으로 —

Abstract

이 연구는 국가인권위원회의 표현의 자유 관련 진정사례 분석을 통해 국가인권위원회의 표현의 자유 보호 활동의 경향과 표현의 자유 인식을 살펴보고자 했다. 이러한 과정을 통해 진정활동의 실효성 문제, 정치적으로 민감한 사안에 대한 소극적 입장표명과 같은 국가인권위원회의 활동을 둘러싼 몇 가지 비판에 대한 개선 전략 구축에 도움을 제공하고자 하였다. 이 연구의 결과는 다음과 같다.첫째, 진정사례 분석 결과, 국가인권위원회 설립 직후 8년 보다 이후 8년 동안 수적으로 많고, 다양한 유형의 표현의 자유 관련 진정사례가 도출되었음을 확인할 수 있다. 이는 국가인권위원회가 사회적 약자들의 인권보호를 위한 활동을 폭넓게 진행해 온 결과로 긍정적으로 평가할 수 있는 부분이다. 둘째, 국가인권위원회는 법리적 판단과 함께 인권법에 근거한 판단을 병행함으로써 표현의 자유를 보다 적극적으로 보장해야할 인권의 가치로 인식하고 있었다. 아울러 국가인권위원회의 표현의 자유 보호 진정은 대부분 사인에 의해 이루어지고 있다는 점과 공인이나 공적단체가 피진정인이라는 점을 확인하였다. 셋째, 국가인권위원회 인권위원장 시기별 표현의 자유 진정사례를 확인할 결과 현 7대 인권위원장 시기에 가장 활발하게 나타나고 있었다. 아울러 5~6대 인권위원장 시기 가장 위축되었음을 확인하였다. 다만, 1~4대 인권위원장 시기보다 5~6대와 7대 인권위원장 시기 정치적 성격을 가진 진정 활동이 축소되었음을 확인하였다. 넷째, 국가인권위원회 진정활동의 실효성을 파악한 결과, 표현의 자유 관련 진정 가운데 집회시위, 개인정보, 성소수자 보호와 관련된 진정의 경우 유사 진정사례가 반복적으로 나타나고 있음을 확인하였다. This study set out to analyze the petition cases related to freedom of expression filed at the National Human Rights Commission and to examine the trends of its activities to protect freedom of expression and its perception of freedom of expression; thus, helping to set an improved strategy regarding a couple of criticisms about the Commission including the effectiveness of its petition activities and its passive expression of its position about politically sensitive issues. The findings were as follows: First, the analysis results of 45 petition cases show that there were 21 cases about assembly and demonstration, 12 cases about personal information, and three cases about the expression of homosexuality. Secondly, Basing its judgments on the Human Rights Act as well as legal principles, the Commission recognized freedom of expression as a value of human rights that should be guaranteed more actively. In addition, petitions to protect freedom of expression were filed against public figures or organizations by private citizens in most cases. Thirdly, the study examined the petition cases regarding freedom of expression filed at the Commission according to the terms of its heads and found that the most active petition cases were during the term of the current seventh head (16 cases for two years, an average of eight cases per year). In addition, petition activities for freedom of political expression were fewer during the terms of the fifth, sixth, and seventh head than those of the first to the fourth head. Finally, the study looked into the effectiveness of the Commission's petition activities and found that there was the repetition of similar petition cases of freedom of expression related to assembly and demonstration, personal information, and homosexuality.
