자진신고 감면제도 개선방안

Abstract

공정거래위원회에서 시행 중인 자진신고 감면제도는 감면액이 너무 많다는 문제점이 지적되고 있다. 이 논문에서는 이 문제를 해결하기 위한 두 가지개선방안을 제시한다. 첫 번째 방안은 현행 제도에서 감면비율을 조정하는 것이다. 가장 먼저 신고하는 기업의 경우의 감면비율은 현재의 100%에서모두 신고하지 않았을 때 해당 기업에게 징수할 수 있는 과징금보다 많지 않는 수준까지 낮춘다. 두 번째 신고한 기업의 경우는 현행 50%에서 감면해 주지 않는다. 두 번째 방안은 신고순서와 상관없이 신고 기업의 수에 따라 차등을 두면서, 신고한 기업과 신고하지 않은 기업이 있는 경우, 신고하지 않은 기업으로 하여금 신고한 기업이 감면 받은 과징금의 일정 금액을 추가 부담하도록 하는 방안이다. 이 방법의 경우, 모두 신고한 경우에는 감면해 주지 않는다. 또한 신고하지 않은 기업에 대한 추가 부담은 다른 기업이 모두 신고한 경우에만 적용하지만 그 비율은 아주 적어도 된다. Leniency program which is used by Korea Fair Trade Committee is criticized because exemption amount is too much. In this paper, I suggest two ways to improve the current program. First and simple way is to reduce exemption rate. More specifically, the rate which is applied to the firm which reports first is reduced from current 100% to the rate which makes the amount a firm which is the first and only reporter pays not greater than the amount when no firm reports. The rate applied to the second reporter is reduced to 0 from current 50%. The second plan uses exemption rate not based on the order of reporting but the number of reporters as well as the penalty to a firm which does not report while the other firm(s) reports. The penalty rate depends on the total exemption amount of the firm which report. The exemption rate when all report is 0. The penalty rate applies only when the other firms report and the rate can be very small.
