IRB와 구술사 연구윤리 : 한민족다문화 협력적 구술생애사 연구 사례를 중심으로

Abstract

2013년 2월 2일 시행된 ‘생명윤리 및 안전에 관한 법률’은 사람을 대상으로 물리적으로 개입하거나 의사소통, 대인 접촉 등의 상호작용을 통하여 수행하는 인간대상연구를 수행하는 자가 소속된 교육, 연구 기관 또는 병원 등은 기관생명윤리위원회(IRB)를 설치하여 인간대상연구를 심의하고 규제해야 한다고 규정하고 있다. 이로 인해 구술사 연구를 포함한 질적 연구가 인간대상연구로 정의되며 생명의학과 행동과학이 지배하고 있는 기관생명윤리위원회의 심의 및 규제 대상이 되었다. 그러나 구술사 연구를 포함한 질적 연구는 현존하고 있는 기관생명윤리위원회의심의 및 규제 대상이 될 수 없다. 그 이유는 인류학과 사회학을 포함하여 구술사 연구는 비판적 학문 영역에 속하기 때문이다. 예컨대 구술사 연구는 인간을 대상으로 하는연구가 아니라 인간의 참여와 협력으로 이뤄지는 연구이다. 한편 구술사학이 자체적으로 연구윤리를 가지고 있다는 것도 중요하지만 왜 구술사 연구윤리와 IRB가 부딪힐 수 밖에 없는지에 대한 구체적인 설명이 필요하다. 이에본 논문은 IRB와 구술사 연구와의 불편한 관계를 미국 상황을 중심으로 요약적으로살펴 본 후 한국 구술사 연구와 연구윤리에 대해 필자가 참여한 한 사례를 중심으로논의해 보고자 한다. The Bio-Ethics and Safety Act of South Korea that came into effect on February 2, 2013, requires the establishment of an Institutional Review Board (IRB)—which will review and regulate all human subject researches —in educational, research, and medical institutions that employ researchers conducting human subject researches which involve interactions such as physical intervention, communication, and interpersonal contact with a living individual. As a result, qualitative researches including oral history are defined as human subject researches and are subject to review and regulation by the IRBs dominated by biomedical and behavioral sciences. Nevertheless, qualitative researches including oral history cannot be subjects of review and regulation by the IRB in its current state. The reason for this is that oral history, not to mention anthropology and sociology, belongs to the discipline of critical studies. For example, oral history does not regard living individuals as the subject of research but as research participants and collaborators. While it is important to illustrate that oral history as an academic discipline has its own robust research ethics, it is also necessary to explain why IRB and the research ethics of oral history are incompatible. As such, this paper seeks to briefly examine the inconvenient relationships between the IRB and the Oral History Association in the U.S. and discuss the issues related to oral history researches and research ethics in South Korea through the author’s oral history research case.
